HIPAA applies to health insurance companies, HMOs and government health programs, which HHS lists as covered entities. HIPAA does not reach most auto, property and casualty, or life insurers as covered entities, and HHS guidance on workers' compensation states that the Privacy Rule does not apply to workers' compensation insurers except to the extent they are otherwise covered entities.

The Gramm-Leach-Bliley Act covers nonpublic personal information held by insurers, and 28 jurisdictions had adopted the NAIC Insurance Data Security Model Law (#668) as of August 2025, per NAIC. The model law requires licensees to oversee third-party service providers. Providers also send records under authorizations that carry their own limits.
