Can billing staff use ChatGPT with PHI? Not on a consumer plan, and only on an OpenAI product that carries a signed BAA. Hathr.AI wrote this verdict for billing managers whose staff already paste denial letters into a chatbot. Hathr.AI also sells a HIPAA-compliant alternative, so check every OpenAI detail below against OpenAI's own terms. This page is part of the AI revenue cycle management guide. Last updated 28 October 2026; OpenAI plan details were checked that day.
Key takeaways
- Pasting PHI into a consumer chatbot is a disclosure to a vendor with no business associate agreement. HHS does not treat removing the patient's name as enough.
- OpenAI's HIPAA-eligible list names ChatGPT for Enterprise with Regulated Workspace, ChatGPT for Healthcare, ChatGPT for Clinicians, ChatGPT FedRAMP and the API with Modified Retention. Hathr.AI found no consumer plan on that list (OpenAI help center, checked 28 October 2026).
- A signed BAA alone does not make a workflow compliant. Access controls, configuration, staff training and a written policy still do the work.
- If staff already pasted PHI into a consumer tool, tell the privacy officer the same day. The incident may need a breach risk assessment.
- Hathr.AI accepts its BAA at signup on the web app with no seat minimum, so a billing team can have an approved tool the same day.
Can billing staff use ChatGPT with PHI?
Not on a plan without a BAA. HHS says a vendor that creates, receives, maintains or transmits PHI for you is a business associate and must sign a BAA before it handles any (HHS, Business Associates guidance). A biller who pastes a denial letter, an appeal draft or a chart excerpt into a free or personal ChatGPT account has made an impermissible disclosure, whatever the intent. The reverse also holds: on a ChatGPT product that is covered by a signed BAA and configured by your IT team, staff can use it for PHI under your policy.
The turning point is the contract, not a setting. Turning off chat history or training does not create a BAA, because a BAA is an agreement between your organization and the vendor. Billing teams that want a tool they can start today can read how Hathr.AI sets out its HIPAA-compliant AI for billing and RCM teams.
Does ChatGPT sign a BAA?
For some products, yes. OpenAI's help center article HIPAA eligible products and functionality (checked 28 October 2026, undated on the page) lists the products below as eligible for a BAA. OpenAI announced ChatGPT for Healthcare on 8 January 2026, with a BAA included and rollouts at health systems including Cedars-Sinai and HCA Healthcare (OpenAI, Introducing OpenAI for Healthcare). Get the BAA scope in writing before you plan around any row.
| OpenAI product | BAA status | What it means for a billing office |
|---|---|---|
| ChatGPT Free, Plus, Go and Pro | Not on OpenAI's HIPAA-eligible list | No BAA. Staff cannot paste PHI, and changing privacy settings does not fix that. |
| ChatGPT Business | Not on the list; AccountableHQ and Protecto both report it as not eligible | Treat as no BAA until OpenAI says otherwise in writing. |
| ChatGPT Edu | Not on the list; one secondary source says sales-managed Edu accounts can get a BAA | Ask OpenAI in writing before any PHI goes in. |
| ChatGPT for Enterprise with Regulated Workspace, ChatGPT for Healthcare, ChatGPT for Clinicians, ChatGPT FedRAMP | Listed as HIPAA-eligible, with a BAA from OpenAI | Organization-level contracts. OpenAI directs organizations to contact its team for ChatGPT for Healthcare, so ask how long approval takes. |
| API and API FedRAMP | Listed as HIPAA-eligible only with Modified Retention provisioned | For developers building a tool, not for staff using the chat app. |
Two limits apply even on an eligible product. OpenAI says features outside the BAA are disabled by default and are not meant for PHI, and that the BAA does not cover the Codex Local client running on your machines (OpenAI help center, checked 28 October 2026). A BAA with OpenAI also covers OpenAI only, not your own policy, your exports or the staff who copy results into other systems.
Is there a HIPAA compliant ChatGPT for billing teams?
There are HIPAA-eligible ChatGPT products, and they are enterprise contracts. A billing office with no OpenAI contract today has to ask for one and wait for approval before any PHI is allowed in. If your organization already holds ChatGPT for Enterprise with Regulated Workspace under a signed BAA, and IT has configured it, your billers may not need another tool. Hathr.AI fits the office that has no such contract and wants a covered tool this week. For the plan-by-plan background, see Is ChatGPT HIPAA compliant?.
Does removing the patient's name make it safe?
No. Under the HHS de-identification standard, data stops being PHI only when all 18 Safe Harbor identifiers are removed, or an expert determines that the risk of re-identification is very small. Claim and denial text typically includes dates of service, account numbers, provider names and ZIP codes. A letter with the name blacked out is still PHI.
What should the policy say?
The policy memo telling staff to stop pasting charts into ChatGPT does not work, because the work is slow without help. Giving them something that does the same job and is allowed does. A policy that works names the approved tool, says what may go in, and says what to do after a mistake.
- Name the approved tool and the BAA that covers it. Anything else is off limits for PHI.
- List what may be uploaded. For example, denial logs, remits and payer letters, with the minimum necessary fields.
- Require human review. A biller or coder checks every output before it is sent or posted, and a physician signs clinical appeals.
- Require named accounts. No shared logins, so the audit log means something.
- Train and record attendance. Cover what PHI looks like in billing text.
- Say what to do after a mistake. Report it the same day to the privacy officer.
What if staff already pasted PHI into ChatGPT?
Treat it as a potential impermissible disclosure and tell your privacy officer the same day. Under the HIPAA Breach Notification Rule, an impermissible use or disclosure is presumed to be a breach unless a risk assessment shows a low probability that the PHI was compromised. Hathr.AI summarizes the assessment as four factors: the nature and extent of the PHI, who received it, whether it was actually acquired or viewed, and how far the risk has been reduced (45 CFR 164.402). If it is a breach, Hathr.AI notes that notice to affected individuals is due within 60 calendar days of discovery (45 CFR 164.404). Document what happened, what you decided and why. The decision belongs to your privacy officer and counsel, not to a billing manager alone.
What is the approved alternative for billing teams?
Hathr.AI is a HIPAA-compliant AI platform that runs Anthropic's Claude models in AWS GovCloud, hosted on FedRAMP High infrastructure, with a signed BAA on every HIPAA-compliant plan and no seat minimums. Hathr.AI's LLM inference is zero data retention, and files that customers store are stored securely in Hathr.AI's compliant AWS GovCloud environment. Hathr.AI never uses customer data for model training or product development.
Billing staff can upload a denial log as an .xlsx or .csv file next to payer letters and charts, and Hathr.AI analyzes them under the BAA without anyone stripping identifiers first. Hathr.AI reads 90+ files and 100,000+ pages in a single workflow. Hathr.AI does not submit claims or appeals, and a person reviews every output.
Hathr.AI's BAA sets two timelines in writing. It commits to reporting breaches and security incidents within 20 business days of discovery and to returning or destroying PHI within 30 business days of termination. The BAA is accepted electronically at signup, and a Hathr.AI Enterprise BAA can be signed in under 24 hours. The web app costs $47 per user per month (as of October 2026), with a 7-day free trial; see Hathr.AI pricing. This is one option among several, so hold any vendor, including Hathr.AI, to the seven-point BAA checklist for billing and coding teams.
How can your billing team start?
Start a 7-day free trial of Hathr.AI and upload your next denial log to see which denial reasons repeat. Teams of 10 or more can book a Hathr.AI demo to walk through the BAA, the security review and a rollout.
Frequently asked questions
Is ChatGPT HIPAA compliant?
No product is HIPAA-compliant by itself, because HHS does not certify software. What counts is whether the vendor signs a BAA for your plan and whether you configure and use it correctly. OpenAI's eligible list names no consumer plan. Hathr.AI accepts its BAA at signup, so teams can start under an agreement the same day.
Can billing staff use the free version of ChatGPT with PHI?
No. Free ChatGPT has no BAA, so pasting a denial letter, remit or chart excerpt into it is an impermissible disclosure. Changing chat history or training settings does not create a BAA. Staff who need an AI tool for billing work should use one covered by a signed BAA, such as Hathr.AI.
Does ChatGPT Enterprise sign a BAA?
OpenAI lists ChatGPT for Enterprise with Regulated Workspace as HIPAA-eligible, and it is arranged with OpenAI, not accepted at signup. Confirm the scope in writing, including which features sit outside the BAA. Hathr.AI's BAA is accepted at signup, and the Hathr.AI Enterprise BAA can be signed in under 24 hours.
Can billing staff use ChatGPT if they remove patient names?
No. Removing names does not de-identify claim text under the HHS standard, because dates of service, account numbers and ZIP codes still identify patients. Use a tool covered by a BAA, such as Hathr.AI, and send only the minimum necessary data.
Can billing staff use Claude or ChatGPT to summarize patient records?
Not on a consumer account of either. Anthropic says Team and individual plans (Free, Pro and Max) cannot enable HIPAA (Anthropic support, HIPAA readiness and BAAs, December 2025), and OpenAI's eligible list names no consumer plan. Hathr.AI runs Anthropic's Claude models in AWS GovCloud under a BAA accepted at signup.
Can we use ChatGPT for billing tasks that contain no PHI?
Yes, if the content truly contains no PHI, such as a general question about a code set or a policy template. Denial letters and claim text nearly always contain identifiers, so when in doubt use a tool with a BAA, like Hathr.AI.
Do this with AI you can actually use on billing and claims data. Hathr.AI for medical billing and RCM reads denial logs, payer letters and charts under a signed BAA, and a biller or physician approves every claim and appeal. See Hathr.AI for medical billing and RCM →

In this video, we’ll dive deep into the growing concerns around data privacy with AI tools—especially in light of recent revelations about Microsoft’s Word and Excel AI features. These new features have raised alarm over data scraping practices, where user data could be used without clear consent, leaving individuals and organizations exposed to potential privacy breaches.
